Terms of Service

1. Scope

These Terms of Service apply to all contracts between Markus Stöger (sole proprietor, Lehmhäusl 23, 3261 Steinakirchen am Forst, Austria) and the customer for the provision of services in the area of AI integration and managed hosting, offered via the website openclaw.markusstoeger.com. By using the website or subscribing to a managed hosting plan, you agree to these terms.

2. Service Description

OpenClaw DACH offers the following services:

  • Setup guides and tutorials (free): Freely accessible step-by-step instructions for setting up and using OpenClaw. No registration required.
  • Managed Hosting (paid): Fully managed OpenClaw instances on EU infrastructure (Hetzner, Germany). Includes automatic updates, backups, and technical support.
  • Email newsletter (free): Optional newsletter with updates and tips. Registration via double opt-in, unsubscribe at any time.

3. Contract Formation

A paid contract is formed when you select a managed hosting plan and complete the order process. You will receive a confirmation by email. No payment details are required for the free trial. The paid service contract only takes effect when you add a payment method after the trial period.

4. Pricing and Payment

The managed hosting plans (all prices incl. VAT where applicable):

Starter: EUR 19 / month

Pro: EUR 39 / month

Business: EUR 69 / month

Billing is processed monthly via Stripe. Accepted payment methods: credit card and SEPA direct debit. Payment is due at the beginning of each billing period. Price changes will be communicated by email at least 30 days in advance.

5. Free Trial

Every managed hosting plan includes a free trial of 7 days. No credit card required. Full features during the trial. After expiry, the instance is automatically paused if no payment method has been added. Your data is retained for an additional 14 days. After that, data is permanently deleted.

6. Term and Cancellation

All plans have a monthly term. Cancel anytime, effective at the end of the current billing period — via the dashboard or by email to office@markusstoeger.com. After cancellation, your instance remains active until the end of the paid period.

7. Availability

We target 99.5% availability per calendar month (excluding planned maintenance windows). Infrastructure is operated on Hetzner servers in Germany (EU). Planned maintenance will be announced at least 24 hours in advance. Pro-rata credits will be issued for prolonged outages.

8. Limitation of Liability

The free guides are provided without warranty. Liability for damages resulting from the application of the guides is excluded to the extent permitted by law.

For the managed hosting service, liability is limited to intent and gross negligence, and capped at fees paid in the last 12 months. These limitations do not apply to personal injury or mandatory statutory liability provisions.

9. Data Protection

Details on data processing in our Privacy Policy. All data is processed on servers in the EU (Germany). No transfer to third countries.

10. Applicable Law

These terms are governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. Jurisdiction: Scheibbs, Lower Austria. For consumers, the mandatory provisions of the Austrian Consumer Protection Act (KSchG) apply.

11. Final Provisions

If any provision is or becomes invalid, the remaining provisions remain unaffected. Changes will be communicated by email at least 30 days before taking effect.

12. EU Dispute Resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
